The damage is their fault! It should have no effect on you or your rates. If you have insurance, you pay for it, use it. Let your company chase/deal with them.

If you don't have insurance, you should be able to take it where you want for repair. Deal direct with his insurance company not the car wash.

The manger at the car wash is a total idiot. Now he is trying to claim that there was a recall on this vehicle for the throttle linkage. He is trying to use this against me. He said I should file it against my insurance. I told him that he must be nuts!!! The estimates are in. 1st estimate is $4850.00. The 2nd estimate is 6550.00. They stated that it needs both an upper and lower control arms, knuckle, left fender, inner fender, bumper cover, and core support. They are self insured, up to $5000.00. Meaning that they have to pay up to $5000.00 worth of damage to the car. After the $5000.00 the insurance will pick up the rest. What do you guys think I should do now? Should I get an attorney? He was also showing me something on carfax, trying to say that there was a TSB for heavy throttle. I assume that this means that the Gas pedal must be too hard for granny to push so GM put in a softer return spring. The dealer check out the throttle linkage and said it was in perfect working order.

WTF? Is this some sort of MD thing? Other than an insurance company keeping records, there is no way for the regular car buyer to know if a car has been in an accident. The only thing that will show up on a check is if the vehicle got a salvage title.

At the end of the day, in a civil suit they only have to make you whole for damages. Now you can try for punitive damages on top of being made whole for your personal loss, but all of this would take a large amount of legal expenses to work through.

As stated before, it seems to me small claims is the way to go. Conversely, do you think you could get $5,000 for that car if you sold it, prior to the accident? If you can get the manager to hand you a check for $5,000 and you get to keep the car, then I'd take the time to find the best Caprice you could for $5,000, take what you want off the old one, and junk it.

just get the dealer to check the lingage..if all is clear, hand the car wash monkey the paper....done

if its not ok, then it didnt happen
